The Council on Environmental Quality (CEQ) issued a final rule on May 1st, 2024, to update the governmentwide regulations implementing the National Environmental Policy Act (NEPA). This CEQ final rule will become effective on July 1, 2024, and will only be applicable to new environmental reviews initiated after July 01, irrespective of the review level.
The regulation integrates the legislative changes to NEPA introduced by the Fiscal Responsibility Act of 2023 (FRA), which was enacted in June 2023. Furthermore, the updated regulation streamlines the NEPA process, revises governmentwide NEPA implementation procedures, enhances efficiency and effectiveness, and promotes broader analysis of environmental and climate change impacts to achieve more resilient and protective project results.
